Purpose and professional use
HeatInput provides calculation aids intended to support qualified welding professionals.
HeatInput does not replace professional judgement, an approved welding procedure, welding coordination, procedure qualification, inspection requirements or compliance with applicable codes, standards, project specifications and client requirements.
Engineering responsibility
Calculation results depend on the values entered, the selected calculation method and the assumptions applicable to that calculation.
You are responsible for selecting the appropriate calculation method, entering correct data and determining whether a result is suitable for its intended application.
Always verify results against the applicable WPS, qualification documentation, project and client specifications, governing codes or standards and calculation method before using them for production, qualification or inspection decisions.
Accuracy and verification
HeatInput is designed to provide accurate, transparent and traceable calculations. However, software may contain errors, and no calculation result should be relied upon without appropriate professional verification.
You remain responsible for independently reviewing and verifying results before using them in professional work.
No professional approval or certification
A result produced by HeatInput does not constitute approval, certification, qualification, acceptance or inspection approval of a weld, welding procedure, welder, fabrication process or project.
Any such decision remains the responsibility of the appropriately qualified person or organisation.
Availability and changes to the service
HeatInput may be updated, modified, interrupted or temporarily unavailable.
De Weerd Welding Service does not guarantee uninterrupted or error-free availability of the service.
New calculations, modules, features and functionality may be introduced, changed or removed over time.
Acceptable use
You may use HeatInput for legitimate personal, professional and business activities.
You must not:
- use HeatInput for unlawful purposes;
- intentionally interfere with, damage or disrupt the service;
- attempt to gain unauthorised access to HeatInput systems or functionality;
- copy, reproduce, distribute or resell HeatInput or substantial parts of it as your own product;
- remove or misrepresent HeatInput branding, ownership notices or attribution; or
- reverse engineer or otherwise attempt to extract protected source code except where applicable law expressly permits this.
Intellectual property
HeatInput, its software, interface, branding, written content and associated materials are owned by or licensed to De Weerd Welding Service unless stated otherwise.
These Terms do not transfer ownership of any HeatInput intellectual property to you.
References to welding standards, codes, organisations, processes or third-party names are provided for technical or informational purposes and do not imply affiliation, sponsorship or endorsement unless expressly stated.
Limitation of liability
To the fullest extent permitted by applicable law, De Weerd Welding Service is not liable for losses or damages arising from:
- incorrect, incomplete or inappropriate input data;
- selection of an inappropriate calculation method;
- incorrect interpretation or application of calculation results;
- failure to independently verify a result;
- failure to follow an applicable WPS, qualification requirement, project or client specification, code or standard;
- use of HeatInput outside its intended purpose; or
- interruption or unavailability of the service.
To the fullest extent permitted by applicable law, De Weerd Welding Service is not liable for indirect, incidental, special or consequential losses, including loss of production, profit, business, contracts or data arising from use of HeatInput.
Nothing in these Terms excludes or limits any liability, right or remedy that cannot lawfully be excluded or limited under applicable law.
User responsibility
You are responsible for how HeatInput results are used in your work and for ensuring that your use of HeatInput complies with applicable laws, regulations, welding standards, project requirements and professional responsibilities.
Future accounts and paid services
The current release may be expanded with user accounts, subscriptions, paid plans, cloud storage or additional professional services.
Where such services are introduced, additional or updated terms may apply. Any applicable commercial terms will be made available before those services are purchased or used.
Governing law
These Terms and your use of HeatInput are governed by the laws of the Netherlands, without prejudice to any mandatory rights or protections that apply under the laws of another jurisdiction and cannot legally be excluded by agreement.
Jurisdiction
Subject to any mandatory law that provides otherwise, disputes relating to these Terms or the use of HeatInput will be submitted to the competent courts of the Netherlands.
Nothing in this section removes any right to bring proceedings in another jurisdiction where applicable mandatory law gives you that right.
Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
Changes to these Terms
These Terms may be updated when HeatInput changes or when new functionality, accounts, subscriptions or other services are introduced.
